TERMS OF SERVICE — MADE IN LAYERS (ONLINE STORE) Last updated: May 17, 2026 By placing an order through madeinlayers3d.com ("the Site"), you agree to these Terms of Service, our Refunds & Issues policy, and our Privacy Policy. If you do not agree, do not place an order. 1. WHO WE ARE Made In Layers ("we," "us," "our") is a small-batch 3D-printing studio operating from Illinois, United States. Contact: madeinlayers3d.store@gmail.com. 2. PRODUCTS ARE CUSTOM-MANUFACTURED Every item is printed to order using fused-deposition (FDM) and/or resin 3D-printing processes. As a result: - Minor layer lines, faint seams, light surface texture, small color shifts between batches, and tolerances of up to ±0.5 mm are normal characteristics of 3D printing and are NOT considered defects. - Colors shown on screen may vary from the finished product due to monitor calibration, lighting, and natural filament variation between spools. - Stated "ships in X days" windows are estimates in business days and exclude weekends, US holidays, and printer downtime caused by factors outside our control. 3. ORDERING, PRICING, AND PAYMENT - All prices are in US dollars and shown tax-inclusive unless noted. - Payment is processed by PayPal (including PayPal Card Fields). We do not store or have access to your full card number. - Placing an order is an offer to purchase. The order is not accepted until we send a confirmation email and capture payment. - We reserve the right to refuse, cancel, limit, or reduce the quantity of any order for any reason, including pricing errors, suspected fraud, stock shortages, or inability to ship to your address. If we cancel a paid order, we will refund it in full to the original payment method. - Promotional codes are single-use, non-transferable, have no cash value, and may be revoked at any time. 4. SHIPPING AND RISK OF LOSS - We ship via the carrier shown at checkout (USPS, UPS, etc.) using rates calculated through Shippo. - Risk of loss and title pass to you when the carrier receives the parcel. Once the carrier scans "in transit," any loss, theft, or delay in transit is a carrier claim. We will help you open a claim but we are not responsible for carrier conduct. - You are responsible for providing a complete and accurate shipping address. If a package is returned because of an incorrect or incomplete address, we will re-ship at your expense. - International orders (if accepted): you are the importer of record and responsible for customs duties, taxes, and fees. 5. RETURNS AND REFUNDS We offer a 30-day return window. Full details — including the free-return policy for defects, who pays return shipping, and the custom-personalization carve-out — are in our Refunds & Issues policy. 6. INTELLECTUAL PROPERTY - All product designs, photographs, 3D model files, written content, branding, and the Site itself are owned by Made In Layers or licensed to us. You may not copy, redistribute, resell, scan, reverse-engineer, or use our designs to train AI models without our prior written consent. - Purchase of a product grants you ownership of the physical item only. It does NOT grant you a license to the underlying design. - User-submitted content (reviews, photos, return-request media) grants us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, and display that content for any lawful business purpose, including marketing. - If you believe content on the Site infringes your copyright, email madeinlayers3d.store@gmail.com with a DMCA-compliant notice. 7. ACCEPTABLE USE You agree not to: - Use the Site to violate any law or third-party right; - Attempt to interfere with, probe, or bypass the Site's security (including rate limits, authentication, or payment validation); - Submit false information, fraudulent payment, or commit chargeback abuse; - Use automated tools to scrape pricing or inventory data. Violation is grounds for immediate order cancellation, account termination, and recovery of damages. 8. DISCLAIMERS AND WARRANTIES THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 3D-PRINTED ITEMS ARE NOT TESTED, RATED, OR CERTIFIED FOR LOAD-BEARING, MEDICAL, AUTOMOTIVE, AVIATION, FOOD-CONTACT, OR CHILD-SAFETY USE UNLESS A PRODUCT LISTING EXPLICITLY STATES OTHERWISE. 9. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, MADE IN LAYERS, ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, IN WHICH CASE THEY APPLY ONLY TO THE EXTENT PERMITTED. 10. INDEMNIFICATION You agree to indemnify and hold Made In Layers harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your misuse of a product (including any use beyond the product's intended decorative or hobbyist purpose), your violation of these Terms, or your violation of any third-party right. 11. FORCE MAJEURE We are not liable for delays or failure to perform caused by events outside our reasonable control, including natural disasters, fires, power or internet outages, equipment failure, supply-chain disruption, carrier delays, labor actions, pandemics, or government action. 12. GOVERNING LAW AND DISPUTE RESOLUTION These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us in writing and give us 30 days to resolve the dispute informally. If the dispute is not resolved, you and Made In Layers agree to resolve all disputes by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in the Illinois county in which Made In Layers' principal place of business is located. You waive any right to participate in a class action, class arbitration, or representative proceeding. You may opt out of this arbitration clause by emailing madeinlayers3d.store@gmail.com within 30 days of your first purchase with the subject line "Arbitration Opt-Out." 13. CHANGES TO THESE TERMS We may update these Terms at any time. The "Last updated" date above will change. Continued use of the Site after changes constitutes acceptance. 14. SEVERABILITY If any provision of these Terms is held unenforceable, the rest remains in effect. 15.
